1. The Agreement 

The Parties 

Zettagrid and the Customer (an entity subscribing to Zettagrid cloud services) agree that by accessing Zettagrid cloud services, you ("The Customer", "you", "your") accept the terms and conditions in the Standard Form of Agreement.

What is a Service Description? 

The Zettagrid Service Description details specific terms for each Zettagrid offering. It forms part of our Standard Form of Agreement (SFOA), which includes:

• General Terms and Conditions

• Service Descriptions 

• Website Pricing Schedule or Executed Zettagrid Proposal 

2. Service Description 

What is Website Hosting?

Web Hosting is the service where Zettagrid provides space on our equipment to deliver a website or web service.

Website Development and \Mmaintenance

You are responsible for developing and maintaining your website and retain all intellectual property rights and copyright for information stored in your allocated website space.

If you contract Zettagrid to develop and maintain your website, we will charge an hourly fee. Intellectual property developed under this contract transfers to you upon payment.

Website Access

Your website space will be accessible from the internet. You must not use your account to store or transmit anti-social, illegal, threatening, defamatory, offensive, or pornographic material, or send or receive obscene, abusive, fraudulent, threatening, or repetitive messages that violate State or Commonwealth laws.

We or an approved person may access your website space to maintain equipment or services. If you do not own the website, you must have the owner's permission and warrant this to us. You indemnify us against claims from the owner related to such access. Failure to provide access upon reasonable request may result in service limitation, suspension, or cancellation.

Website Traffic

Each service plan includes a monthly data traffic quota. Both inbound and outbound internet traffic count toward your quota.

Traffic within the Zettagrid network and peering partners is excluded from your monthly quota.

Firewall and Logical Security

You are responsible for securing your website code against vulnerabilities. We may suspend your service if we detect a compromise and you do not address it within a reasonable time.

We are not liable for any content, security breaches, distribution of protected information, or malicious activity on your website.

Payment

Payment for the service is required in advance.

Excess charges on your plan will be billed monthly in arrears.

If excess charges exceed 100% of your contract value during a month, we may invoice you immediately.

Service Level Rebates 

This service qualifies for rebates when unavailable as per the General Terms and Conditions. The following apply:

If your service is interrupted due to software or coding incompatibility or a security breach, it is ineligible for service level rebates.
